Between Briefsync and Users/Clients using this membership hosting.

Agreement is a Legally Binding Contract between Users/Clients and Briefsync.net

Briefsync (“we” or “us”) is pleased to provide you with access and use of our websites and services (hereinafter referred to as “Site” or “Sites”).
By using the Services, you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Services.

Account Eligibility

By registering for or using the Services, you represent and warrant that:
You are eighteen (18) years of age or older. The Services are intended solely for Users who are eighteen (18) years of age or older. Any registration, use of or access to the Services, by anyone under eighteen (18) is unauthorized and is a violation of this Agreement.
If you use the services on behalf of another party you also in violation of this agreement.
It is your responsibility to provide accurate information when registering with Briefsync.net. If there is ever an abuse issue or we need to contact you, we will use the primary email address we have on file.
Providing false contact information of any kind may result in the termination of your account, which means you may be required to provide government issued identification and possibly a scan of the credit card used for verification purposes. Failure to provide the information requested may result in your order being denied.
You agree to be fully responsible for all use of your account and for any actions that take place through your account including client portal and the website itself including web hosting you subscribed to. It is your responsibility to maintain the confidentiality of your password and other information related to the security of your account.

User Account and Reset password

Each member will have 2 account, client portal and
control Panel:
Client Portal will have access to Billing, managing
domain name and developer assistance for creating website.
Control Panel will have access to emails and web hosting.

*Resetting password requires access to primary email address.

Membership Plans, monthly and yearly rates

You are permitted to modify your plans at any point, with adjustments made on a pro-rated basis. All features from prior plans remain intact; however, updates that fall outside of other plans will not be accessible. This applies to both monthly and yearly arrangements.

In the event of increased development costs or the addition of new features across all plans, Briefsync may adjust the pricing of existing memberships. Rest assured, we always provide our users with advance notice of at least 3 months before any changes take effect. Don’t forget to keep an eye on your inbox for updates!

Transfer/Migrate website to Briefsync hosting

Transferring a website can often be more complex than anticipated. In fact, many existing sites are built on outdated programming, resulting in slow loading times and incompatibility with the latest WordPress and web hosting standards. At Briefsync, we address this issue by completely reprogramming your website using modern techniques to enhance loading speed. You can choose to retain a design similar to your current site or opt for an entirely new concept. The decision is yours.

When transferring or migrating website, we only accept WordPress and the proper stricter of the WordPress site, another word if the site is not properly to our standard then it usually takes 14 days to 28 days depending on the size of the website and content.

Website and Content

We do not accept illegal, invalid or unenforceable by a court of competent jurisdiction, the remaining provisions or portions (unless otherwise specified) thereof shall remain in full force and effect. 

Developer/Personal Assistance
Developer Assistance is a Collaboration and Communication

• Collaboration is a pin point and comment including upload on a website for creating or update, or both
• Communication is used with Ticket Support and Chat

Free Website and Developer Assistance

Free website is free of charge of development fee as long you are an active members of the  Briefsync.

Every Users/clients who sign up for membership gets free website. A free website is only accessible when membership is active. In order to claim free website you must request through client Portal. Free website development takes 14 days to 28 days. Developer Assistance does not start till we have all the information of the website. So be sure to login to Client Portal and fill in the forms. Having the support of a developer in creating your website ensures that the design and layout are based on the chosen WordPress theme only preferred by the user.

*Important: 24 hours perdiod of no receive is not counted for “free website development duration”

Data & Server

At Briefync we keep your data in store to security and privacy. We have the right to use your data to serve you. All of your data are not shared with any 3rd Party except our partners. This is to ensure we are able to serve you.

Server:  We have partnerered with hosting company to host, backup and mirror website to ensure any uninterrruption.
Client Portal: We have partnerered with CMS (Content management system) and Client Portal for the best performance and communication between Briefsync and users/clients 

Website and Web host (uptime)

Web hosting servers, responsible for hosting websites and ecommerce platforms, rely on electricity which can be disrupted by natural disasters such as floods and storms. To ensure uninterrupted service, we maintain mirror servers that back up your website every two weeks to weekly depending on your plans. In the event of a primary server failure, the latest backup is displayed to keep your online presence active. The internet provider imposes restrictions on the bandwidth available to web hosts. If you exceed the allotted bandwidth, notifications will be sent to you via both the client portal and email. A one-week advance notice will be provided before suspension is enforced.

The purpose of unlocking website or web hosting is to take control on your own, which we highly recommend to have website knowledge. Once you unlock a website to take over a development site, you will lose Developer assistance and will not be able to request to update website while it’s unlocked, and will lose a features “developer assistance” permanently.

Unlocking webhosting and transfer free website (losing developer/personal assistance service)

At Briefsync we highly reccomment to keep web hosting lock which means unaccessible to web host server and the website (WordPress) files. This is to ensure your personal assistance is uninterrupted. This means users/client can not access to backend server such as cPanel, ftp and WordPress which becomes difficult to transfer website. To transfer website out of Briefsync server you need to unlock Web Hosting server.

Unlocking Web hosting to access the cPanel and the website (WordPress) files cost $800 starting plus any apps we install, normally we charge by hourly or flat fee, which ever is higher.

Flat Fee:

Website – Starting at $800
Apps – Starting at $100
Logo – Starting at $150

Once you unlock web hosting, you lose the feature developer/personal assistance, and more importantly you become responsible for your web hosting and any interuption you may have cause to the server.

You will have access to ftp hosting server, where you can have unlimited backup and transfer your website to any hosting of your choosing. If you decided to bring back the website, it not guaranttee to get developer/personal assistance due to any modification to the website. For that reason we may have to recreate the website all over again as if you are new client. To recreate the website, locking Web Hosting (cPanel/FTPand WordPress is mandatory which will becomes unaccesible.

Backup Website

Backing up website only backs up website (WordPress) and apps that are installed to WordPress.
Backup only saves 1-2 weeks, after it deletes the website and apps, you will not have acess anymore.

Domain Name (1st year free)

Purchasing Domain Name is a yearly billing, and by default it’s automatic renewal. In order to “turn off auto renewal” you must login to client portal and turn it off.

Should you choose to terminate the complimentary domain name within a twelve-month period, you will have the opportunity to acquire it separately. Should you choose to terminate your membership after a year, please note that the charges for your domain name will continue to be applied separately. This is imperative as the domain name serves as your legal address, signifying your ownership. Your domain name will always have access regardless of your membership plan.

Setting Panel

There is two different platform when it comes to Briefsync.net, one is Client Portal and the other is Control Panel.
• Client Portal is a “Developer Assistance” that makes it easy for lot of clients who do not have a great knowledge with domain and hosting including creating website
• Control Panel is complete direct function of your hosting and billing.
• And for that reason, both has it’s own login of username and password. Both login information will present in client portal.

Apps

Apps can be installed on a website depending on membership plans and with that, you can request through client portal for apps to be installed on any part of the website. We are developing more apps to enrich the website better for your users/clients. And sometimes we uses 3rd party maker to install which may take sometimes then normal. The designation of Alpha or Beta indicates that the project is in the midst of development, signifying its incomplete status.

Cancellation/Suspension

Late payment of bills can have serious consequences for any business, leading to financial strain and potential legal action such as temporarily suspension of your account. In the case of a 3-month non-payment, the situation becomes even more dire, putting the stability and reputation of the business at risk which would lead to suspension and possible shutting down your account, permanently.

Should you choose to terminate your membership after a year, please note that the charges for your domain name will continue to be applied separately. This is imperative as the domain name serves as your legal address, signifying your ownership.

Furthermore, engaging in the dissemination of illegal content can result in severe legal penalties and damage to the company’s credibility. It is imperative that all businesses prioritize timely payments and ensure that their content adheres strictly to lawful standards to avoid these detrimental outcomes.

Refund Policy

We do offer refund for monthly or yearly subscription.
We don’t offer is refund on domain name. Free domain name are also not refundable as they are paid by Briefsync and not users/client.
However if you decide to refund during free domain name (1st year), then we subtract the free domain name on a total of the yearly subscription.

Domain Name are not refundable wheter it’s free or the yearly cost.

Payment Gateway

It is imperative to note that we utilize both PayPal and Stripe as our payment gateways. Please be advised that we bear no responsibility for any payment transactions. In the event of any issues, it is essential that you directly liaise with them or grant us authorization to engage with the payment provider.

Shipping

The complexity of the shipping system arises from the varying coding and systems employed by different shipping providers. Nevertheless, with developer support, we are able to establish connections with major carriers such as Canada Post, UPS, and FedEx.

It is imperative to emphasize that we bear no liability for any shipping delays or issues.
